1. General

These Terms and Conditions ("Terms") apply to all sales of goods and services by Polychem Far East Co. Ltd., unless otherwise agreed in writing. By placing an order, the Buyer agrees to be bound by these Terms.

2. Orders and Acceptance

All orders are subject to written acceptance by Polychem Far East.
Quotations are valid for thirty (30) days unless otherwise specified.
Polychem Far East reserves the right to correct any clerical errors in quotations, invoices, or other communications.

3. Products and Specifications

Products include, but are not limited to, fiberglass reinforcements, resins, pigments, cleaning agents, thermal insulation materials, and electrical infrastructure components as listed in the company’s product catalog.
All technical specifications provided are intended as general guidance. Buyers are responsible for ensuring the suitability of products for their intended applications.

4. Prices and Payment Terms

Prices are exclusive of VAT and other applicable taxes, unless stated otherwise.
Payment is due within thirty (30) days of invoice unless otherwise agreed.
Late payments may incur interest at 1.5% per month or the maximum allowed by Thai law.

5. Delivery and Risk

Delivery times are estimates only. Polychem Far East is not liable for delays caused by third-party logistics or force majeure events.
Risk of loss or damage transfers to the Buyer upon delivery at the designated location.

6. Retention of Title

Ownership of goods remains with Polychem Far East until full payment has been received.

7. Returns and Claims

No returns will be accepted without prior written authorization.
Claims for defective goods or incorrect shipments must be made within seven (7) days of delivery.
Polychem Far East’s liability is limited to replacement of goods or refund of purchase price.

8. Compliance and Safety

Buyer agrees to comply with all local laws and safety regulations regarding the use, handling, and storage of goods.
Products may contain chemicals regulated under Thai and international law; appropriate handling procedures must be followed.

9. Warranty and Liability

Goods are warranted to conform to published specifications at the time of shipment.
Polychem Far East shall not be liable for indirect, incidental, or consequential damages.
Total liability under any contract shall not exceed the amount paid by the Buyer for the affected goods.

10. Force Majeure

Polychem Far East shall not be held responsible for failure to fulfill obligations due to events beyond its control, including but not limited to natural disasters, political unrest, strikes, and global supply disruptions.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of the Kingdom of Thailand.
Any disputes shall be resolved in the courts of Thailand.
